4. Limitation of liability
4.1 Nothing in this Agreement limits either party's liability for death or personal injury caused by negligence, or for fraud.
4.2 Each party's aggregate liability under this Agreement shall be unlimited capped at the fees paid in the preceding 12 months.
4.3 Neither party shall be liable for any indirect or consequential loss.
